Acceptance of Terms

Agreement

By accessing or using Lovorecord's services, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use our services.

Eligibility

You must be at least 18 years old to use our services. If you are between 13 and 18, you may use our services only with the consent and supervision of a parent or legal guardian.

Changes to Terms

We may update these terms from time to time. We will notify you of material changes via email or through our platform. Continued use after changes constitutes acceptance of the new terms.

Our Services

Music Distribution

Lovorecord provides digital music distribution services, delivering your music to streaming platforms and digital stores worldwide. We act as your distributor, not your label or publisher.

Analytics & Reporting

We provide real-time analytics and reporting on your music's performance across platforms. Data accuracy depends on information received from streaming services.

Royalty Collection

We collect royalties on your behalf from streaming platforms and digital stores. Royalties are paid according to your subscription plan terms and our payment schedule.

Service Availability

We strive for 99.99% uptime but do not guarantee uninterrupted service. We may perform maintenance or updates that temporarily affect availability.

Your Content & Rights

Ownership

You retain full ownership of all content you upload. Lovorecord does not claim any ownership rights to your music, artwork, or other creative works. Your music is yours. Always.

License Grant

By using our services, you grant Lovorecord a non-exclusive license to distribute, reproduce, and display your content solely for the purpose of providing our distribution services.

Representations

You represent and warrant that you own or have the necessary rights to all content you upload, including music, samples, artwork, and metadata. You are responsible for clearing all samples and licenses.

Content Guidelines

Content must not infringe on third-party rights, contain illegal material, promote hate or violence, or violate platform guidelines. We reserve the right to remove content that violates these guidelines.

Section 04

Payments & Fees

Subscription Fees

Subscription fees are billed according to your chosen plan (monthly or annual). Fees are non-refundable except as required by law or stated in our refund policy.

Royalty Payments

Royalties are paid monthly for balances exceeding the minimum threshold ($10 USD). Payment methods include direct deposit, PayPal, and other supported options.

Commission Structure

Our commission structure varies by plan. Free tier: 15% commission. Starter: 10% commission. Pro and Label: 0% commission. You keep 100% of royalties on paid plans (Pro and above).

Taxes

You are responsible for all applicable taxes on royalty income. We may withhold taxes as required by law. You must provide accurate tax information for payment processing.

Section 05

Prohibited Activities

Fraud & Manipulation

Artificial streaming, bot plays, stream manipulation, and any form of fraud are strictly prohibited. Accounts engaged in such activities will be immediately terminated without refund.

Copyright Infringement

Uploading content you don't have rights to distribute is prohibited. This includes unauthorized covers, uncleared samples, and pirated content. DMCA violations result in immediate takedown.

Misrepresentation

Providing false information about yourself, your content, or your rights is prohibited. This includes fake metadata, misleading artist names, or impersonation.

System Abuse

Attempting to hack, reverse engineer, or abuse our systems is prohibited. This includes automated scraping, API abuse, and attempts to circumvent security measures.

Section 06

Termination

By You

You may cancel your subscription and close your account at any time through your account settings. Upon cancellation, your music will be removed from stores within 2-4 weeks.

By Lovorecord

We may suspend or terminate your account for violation of these terms, fraud, illegal activity, or at our discretion with 30 days notice. Serious violations may result in immediate termination.

Effect of Termination

Upon termination, your right to use our services ends. We will pay any outstanding royalties owed to you. Content takedown from stores may take 2-4 weeks to complete.

Data Retention

We retain certain data as required by law and for legitimate business purposes. You may request deletion of personal data subject to legal retention requirements.

Section 07

Limitation of Liability

Disclaimer

Our services are provided 'as is' without warranties of any kind. We do not guarantee specific results, earnings, or platform acceptance for your music.

Limitation

To the maximum extent permitted by law, Lovorecord's liability is limited to the fees you paid in the 12 months preceding any claim. We are not liable for indirect, incidental, or consequential damages.

Indemnification

You agree to indemnify Lovorecord against claims arising from your content, your use of our services, or your violation of these terms or third-party rights.

Third-Party Platforms

We are not responsible for the actions, policies, or failures of streaming platforms and digital stores. Platform-specific issues should be directed to those platforms.

Governing Law & Disputes

These terms are governed by the laws of India. Any disputes shall be resolved through the courts located in Islampur, Uttar Dinajpur, West Bengal, 733202, India, except where prohibited by law. You agree to waive any right to participate in class action lawsuits.
